This Act provides for establishment of municipal corporations in the state of Karnataka. It consists of 509 sections over 23 chapters: I. Preliminary; II. Establishment Of Corporation; III. Municipal Authorities; IIIA. Area sabhas and Ward Committees; IV. Election; V. Powers and Function of the Corporation and Other Authorities; VI. Procedure of the Corporation and Committees; VII. Corporation Officers and Servants and their Appointment and Conditions of Service; VIII. Essential Services; IX. Power of Government; IX-A. Establishment of the Karnataka Property Tax Board; X. Taxation Enumeration of Taxes; XI. Finance, Accounts and Audit; XII. Property and Contracts; XIII. Water Supply and Sewerage; XIV. Streets; XV. Regulation of Buildings General Powers; XVI. Nuisance; XVII. Licenses and Fees; XVIII. Prevention of Diseases Dangerous Diseases; XIX. Rules, Regulations and Bye-Laws Rules; XX. Penalties; and XXI. Procedure and Miscellaneous.
Chapter I contains short title, extent, commencement and definitions. Chapter II provides for the procedure to establish a municipal corporation. Chapter III defines the municipal authorities to carry out the provisions of the Act, namely, the Corporation; the Standing committee; and the Commissioner. It lays down the constitution of the authorities and their terms of office. Chapter IIIA contains provisions relating to area sabhas and ward committees. Chapter IV provides for election in the corporation. Chapter V lays down the general powers, obligatory and discretionary functions of a corporation, functions of a mayor, standing committees and commissioner. Chapter VII contains provisions for appointment of officers and employees and conditions of service. Chapter VIII empowers the corporation to declare certain services to be essential services. Chapter IX-A contains provisions relating to establishment and management of Karnataka Property Tax Board. Chapter X provides for imposition of taxes such as property tax, solid waste management cess etc. Chapter XI describes the corporation fund and moneys receivable therein. It also provides for audit of accounts of all receipts and expenditure of the corporation. Chapter XII allocates the corporation property, powers to acquire property and general powers relating to contracts including tenders.
Chapter XIII contains provisions relating to water supply and sewerage including construction of waterworks, water charges, public water supply, prohibition on misuse of water and other acts, inspection, maintenance of sewers and sewage disposal works. Chapter XV requires owner or occupier of a building to provide rain water harvesting structure for storage for reuse or for ground water recharge. Chapter XVI prohibits construction of wells, tanks, etc., without the Commissioner's permission and contamination of drinking water. Chapter XVII provides for licences and fees in respect of lodging houses, animals, stables and sheds, bathing and wash houses, slaughter houses etc. Chapter XIX empowers the government to make rules to implement the Act and the corporation to make regulations and bye-laws. Chapter XX provides for penalties for offences including failure to comply with solid waste management scheme. Chapter XXI contains provisions in respect of appeals from orders passed by authorities under the Act, requisition of land, recovery of taxes and compensation for damage to corporation property.
